  1. Interpretation
     In these Terms and Conditions ( Terms ), the following words and phrases shall have the following meanings:
    “ the Buyer” means the person, firm or company who purchases the Goods from the Company:
    “ the Company” means GlassesOnSpec.co.uk of registered address: Unit 7, Old Close, Watford, WD18 9RU.
    “ Contract” means the contract between the Company and the Buyer which shall be deemed to incorporate these Terms;
    “ Goods” means any goods  agreed in the Contract to be supplied by the Company to the Buyer;
    “ Place of Delivery” means the place to which the Goods are to be delivered.
    In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.

  2. The Contract
    The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer. 
    No terms and conditions contained in the confirmation of order, purchase order or other document  of the Buyer will form part of the Contract.

  3. Delivery
    Unless otherwise agreed in writing, the Place of Delivery shall be the address specified on the order form or the address input at time of order.
    Any dates specified by the Company for delivery of the Goods are intended to be an estimate only. Every attempt shall be made to deliver the goods within 14 working days of placing an order, however delivery may take up to 28 days depending on circumstance.
    the Company, cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. If delivery is not within the agreed time the Company will arrange another time for delivery.
    Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the Goods nor will any delay entitle the Buyer to terminate or rescind the Contract unless the delay exceeds 60 days.

  4. Limitations Of Supply
    By English law we are not allowed to supply spectacles to persons under 18 years of age – please do not request us to do this.
    We are not allowed to supply anyone registered as blind or partially sighted.
    The Company manufactures the product based upon your prescription details, entered in to the website, or on the order sent /faxed to us. The prescription cannot be more than 2 years old and must have been issued by a registered ophthalmic optician.
    We do not supply spectacles with single vision lenses of a spherical power greater than +8.00 and –8.00 (dioptres) and a cylindrical power greater than +4.00 and –4.00 (dioptres) - please do not request us to do this.
    We do not supply varifocal or progressive lenses.  Unless informed otherwise the Company will use an average PD (Pupilliary Distance) value of 63MM.  If you do not wish us to use this value you need to provide us with these numbers as supplied by your optician or yourself, having followed the measuring instructions on our website.

  5. Risk and Inspection of Goods
    Risk in the Goods shall pass to the Buyer on delivery
    Once the goods have been delivered you should inspect them carefully. You should re check your prescription (encased with goods) If any of the goods are damaged , lost or are not of your prescription you should inform us of the problem and you should not use the goods.
    If the company recommends that you purchase optional products during your order process and you do not accept these recommendations, the company will not take responsibility for goods not taken as being aesthetically pleasing or breakages due to non recommended lenses.

  6. Price
    The price for the Goods shall, unless otherwise agreed, be the price set out on the date of delivery in the Company price list indicated on the internet website and in the company catalogue. The price for the Goods shall be exclusive of all costs of carriage which the Buyer shall pay in addition (as stated on the internet and in the catalogue).

  7. Payment
    Unless otherwise agreed in writing, the buyer must pay for the goods at the time of placing the order.
    Payments to us must be paid in pounds sterling.

  8. Your rights of cancellation
    If this contract has been made between us by telephone or correspondence (including e-mail) without any face to face contact having occurred between us, then you will have a 7 day period from the date of order placement in which to cancel this contract. This right does not apply at any time after we have started to customise any materials (including manufacturing any goods) in accordance with your requirements.

  9. Resale of goods
    Goods are sold on the basis that they are not resold to the general public.

  10. Recording of Telephone calls
    The Company may record calls made to our customer services team from time to time for training purposes.

  11. Disclaimer of Warranty
    The content (as defined below) contained in this site is provided by the Company as a service to its customers. This site does not contain information about  eye diseases, nor does this site contain medical information that may be relevant to your eye care needs. the information provided in this site is only general health information, and is intended only to facilitate communication between you and your optician or doctor.  This site does not provide medical diagnosis for any individual and must not be used as a substitute for professional medical advice, diagnosis, treatment or care. Any medical questions you may have about your specific medical condition, treatment, care, or diagnosis must be presented to your registered Ophthalmic Optician. You should never disregard medical advice or delay seeking professional advice because of any information contained in or related to this site. The Company does not endorse, operate, control, or assume responsibility for any product, brand, method, treatment, information or service on this site. The information, services, and products contained in this site are provided "as is" without warranty of any kind, express or implied.

  12. Limitation of Liability
    The Company liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed more than the value of the goods provided and the Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.
    Our maximum liability (and that of our employees, agents and subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £10,000.
    The company (including subcontractors, subsidiaries, employees or agents) does not accept liability for any consequential or incidental damages (included but not limited to lost profits, loss of privacy) or for any other indirect, special, or punitive damages whatsoever that arise out of or related to the use of the site or the purchase or use of any products or services from the site. you agree to indemnify and hold us, and our subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable lawyers` fees, made by any third party due to or arising out of content you submit, post to or transmit through the site, your use of the site, your connection to the site, your violation of the terms of use, or your violation of any rights of another.

  13. Our Responsibilities
    We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this due to circumstances outside of our reasonable control, in particular, we will not be held responsible for delays caused by our suppliers.

  14. Contract personal to you
    This contract is personal to you. Nobody other than you will be able to benefit from this contract. You may not transfer your rights or the benefits/ provisions provided to any other person without our written consent.

  15. Our Rights to Transfer the Contract
    We may assign or subcontract the contract or any part of the contract, to any person firm or company.

  16. Data Protection
    We abide by the terms of the data protection act 1998 and collect only that information that is necessary to fulfill our obligations to you.

  17. Use of Cookies
    This website makes use of cookies. Please ensure that you have your cookies enabled within your web browser.  Cookies are used as a way of recognising who you are when you log in. It enables us to tailor information to suit your requirements from time to time.

  18. 30 Day Guarantee
    The 30 day guarantee period begins from date of order of goods. The guarantee covers goods that have a manufacturing fault only. If this is the case please return your glasses to the Company and we will replace them free of charge. The guarantee does not cover glasses that are ill fitting or non aesthetically pleasing to the wearer. If you wish to return your glasses for a refund for this reason you need call 0871 200 3720 for a refund amount and  return the glasses, with the case and cloth in good order,  at which point we will consider refunding an amount for the frame only.  We cannot refund the cost to manufacture the lenses as these are custom made to your prescription even though this cost is not passed on the customer it still remains a cost that we carry.

  19. General
    Any communication with us regarding this contract should be made in writing to the address in clause 1 of this contract.
    These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.
